This is news to me. I do find this very interesting. My guess is that they didn't have a proper disclaimer and/or customer agreement that thier products are for off road use only.

SCT and bullydog is a recent one. It is not the first one though.
The question is what will other companies have to change to avoid this?
What will the custom tuners like Ray do???
My concern is that the feds might be on to the 'not for on-road use' we all kind of agree to when we purchase these, but the reality is that we all use them on-road. I mean how many people have 2016-2018 vehicles that they only use off-road??
This is from 6 years ago. I remember I traded my 08 for my 03 the day of this happened. There was a big scandal with bully dog then at the same time. There was another company, the maker of the Black Max also involved. They were out by Las Vegas. Damn their name escapes my old brain. I beta tested the Black Max for the DPF and EGR deletes which I was one of the pioneers.

I'm reluctant to say much more about what I know on this. Unfortunately I was up to my neck in it back then. But got away under the radar.

Hopefully, under this current administration, the EPA will have it's wings clipped soon. Until that day comes I feel that ANY company advertising and selling emissions delete parts, and tuning is going to be on their radar.....no matter what type of disclaimer they have the customer sign.
That's how it reads to me too. What @Polaraco is talking about happened several years ago where the EPA went after H&S for selling devices with "off road" tuning already installed.
I always thought that SCT and Bully Dog tuning was emissions compliant, and only aftermarket custom tuning crossed the line to "off road" status.
